Acceptable Use Policy

1. Overview

This Acceptable Use Policy ("AUP") supplements and is incorporated into the GoPinger Terms of Service. By using GoPinger ("the Service"), you agree to comply with this AUP. Capitalized terms not defined herein have the meanings set forth in the Terms of Service.

Violation of this AUP may result in immediate suspension or termination of your account without prior notice, at GoPinger's sole discretion. No refunds will be issued for accounts terminated due to AUP violations.

2. Prohibited Activities — General

You agree not to use the Service for any purpose that is unlawful or prohibited by this AUP. Without limiting the foregoing, you shall not:

Engage in any activity that violates any applicable local, state, national, or international law or regulation
Engage in fraudulent, deceptive, or misleading conduct of any kind
Infringe upon or violate the intellectual property rights, privacy rights, or other rights of any third party
Transmit, distribute, or store any material that contains viruses, malware, trojan horses, worms, ransomware, or any other harmful or destructive code
Attempt to gain unauthorized access to the Service, other user accounts, or any computer systems or networks connected to the Service
Use the Service to store, transmit, or distribute any content that is illegal, obscene, defamatory, threatening, or otherwise objectionable
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity

3. Monitoring & Endpoint Restrictions

The core function of GoPinger is to monitor endpoints on your behalf. You agree to the following restrictions:

You must own or have explicit written authorization to monitor every endpoint you configure in the Service
You shall not use the Service to monitor endpoints for the purpose of gathering competitive intelligence about third-party services
You shall not configure monitoring checks designed to trigger denial-of-service conditions on target endpoints, including but not limited to excessive request frequencies, oversized payloads, or deliberate resource exhaustion
You shall not use monitoring data to reverse-engineer, replicate, or interfere with third-party systems or services
You shall not configure checks at frequencies that may overwhelm, disrupt, or degrade the performance of target endpoints or the Service itself
You shall not monitor endpoints hosting illegal content or services operating on the dark web
You are solely responsible for any consequences arising from monitoring endpoints you have configured, including but not limited to complaints from endpoint owners, legal actions, or service disruptions

4. Status Page Restrictions

If you use GoPinger's status page features, you agree to the following:

You shall not create status pages that are misleading, fraudulent, or impersonate other organizations or individuals
You shall not use status pages to host illegal, offensive, or objectionable content
You shall not use custom domain functionality to impersonate other organizations, create phishing pages, or engage in domain squatting
GoPinger reserves the right to remove, disable, or modify any status page content at any time without prior notice if, in our sole judgment, it violates this AUP or poses a risk to the Service or its users

5. API & Integration Abuse

You agree to use the GoPinger API and integrations responsibly:

You shall not exceed the documented API rate limits for your subscription plan
You shall not attempt to circumvent rate limits through any means, including the use of multiple accounts, API keys, or IP addresses
You shall not perform automated credential stuffing, brute-force access attempts, or vulnerability scanning against the Service
You shall not use the API for purposes of scraping, bulk data extraction, or any use beyond the Service's intended functionality
You shall not create multiple accounts to circumvent plan limitations or usage quotas

6. Email Monitoring Restrictions

If you use GoPinger's email monitoring features, you agree to the following:

You shall only monitor email systems that you own or for which you have explicit written authorization to monitor
You shall not use email monitoring capabilities for surveillance of individuals without their consent or in violation of applicable privacy laws
You shall comply with all applicable email privacy laws and regulations, including but not limited to CAN-SPAM, GDPR, CASL, and any other relevant legislation in your jurisdiction
You shall not use email monitoring features to intercept, collect, or store personal communications without authorization

7. Screenshot Monitoring Restrictions

If you use GoPinger's screenshot monitoring features, you agree to the following:

You shall only enable screenshot monitoring for web pages that you own or for which you have explicit authorization to capture visual records
You shall not use screenshot monitoring to capture, collect, or archive personal data of third parties displayed on monitored pages without a lawful basis under applicable data protection laws
You shall not enable screenshot monitoring on pages containing sensitive personal data (e.g., health records, financial account details, government identifiers) unless you have implemented appropriate safeguards and have a lawful basis to process such data
You acknowledge that screenshots may incidentally capture personal data visible on monitored pages, and you are solely responsible for ensuring that such capture complies with applicable privacy laws and regulations, including obtaining any required consents from data subjects
You shall not use screenshot captures to surveil individuals, gather competitive intelligence, or for any purpose other than monitoring the visual state of your own web properties
GoPinger is not responsible for any personal data incidentally captured in screenshots of your monitored endpoints. You remain the data controller for all content displayed on your monitored pages

8. Resource & Infrastructure Abuse

You agree not to abuse GoPinger's infrastructure resources:

You shall not use the Service for cryptocurrency mining, operating proxy or relay services, or any purpose other than the Service's intended monitoring functionality
You shall not deliberately attempt to exhaust system resources, storage, bandwidth, or processing capacity
GoPinger enforces fair use limits on distributed monitoring via probes. Excessive or abusive probe usage may result in throttling or restriction
GoPinger reserves the right to throttle, restrict, or suspend any account whose usage materially impacts the Service's performance or availability for other customers

9. Account Conduct

Each individual or legal entity is permitted only one free plan account. Creating multiple accounts to obtain additional free resources is a violation of this AUP
You shall not share your account credentials with unauthorized individuals
You shall not create a new account to circumvent a prior account suspension, ban, or termination
If you manage an organization account, you are responsible for ensuring all team members comply with this AUP. Violations by any team member may result in action against the entire organization account

10. Incident Management & On-Call Abuse

You shall not create false or fraudulent incidents to harass, alarm, or mislead team members or third parties
You shall not abuse escalation policies to spam notifications to individuals or services
You shall not use postmortem or incident reporting features to publish defamatory, harassing, or threatening content

11. Enforcement & Remedies

GoPinger reserves the right, in its sole and absolute discretion, to determine whether any conduct violates this AUP. Our enforcement actions may include, without limitation:

Warning: A written notice describing the violation and requesting corrective action
Throttling: Temporary reduction of service capabilities or rate limits
Suspension: Temporary suspension of account access pending investigation or corrective action
Termination: Permanent termination of your account and deletion of all associated data

For severe violations, GoPinger reserves the right to immediately terminate your account without prior warning. No refunds of any kind will be issued for accounts terminated due to AUP violations.

GoPinger reserves the right to report any illegal activity to the appropriate law enforcement authorities and to cooperate fully with any resulting investigation. GoPinger further reserves the right to pursue any and all legal remedies available for damages caused by violations of this AUP.

12. Reporting Violations

If you become aware of any violation of this AUP, please report it to [email protected]. Good-faith reporters are protected from retaliation.

13. Changes to This Policy

GoPinger reserves the right to modify this AUP at any time. We will notify users of material changes by email or through a prominent notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the updated AUP.
